1. Who we are

This website, luxprop.agency (“the site”), is owned and operated by Iconic Lux Properties (Pty) Ltd, a private company incorporated in the Republic of South Africa, trading as LuxProp. Where this policy refers to “we”, “us” or “our”, we mean Iconic Lux Properties (Pty) Ltd.

We are a registered estate agency operating across Johannesburg’s northern suburbs. Our practitioner Fidelity Fund Certificates are displayed in the footer of every page of this site.

This policy explains what personal information we collect about you when you use luxprop.agency, why we collect it, who we share it with, how long we keep it, and the rights you have under the Protection of Personal Information Act, 2013 (“POPIA”).

2. The personal information we collect

We only collect personal information you choose to give us, plus a small amount of technical data your browser sends automatically.

Information you give us directly when you:

  • Submit a contact form — your name, email address, mobile number, and the contents of your message
  • Submit a Landowner’s Edge enquiry — your name, email, mobile, suburb of the property, address, current zoning, your involvement in the property, and any notes
  • Submit a Built for You enquiry — your name, email, mobile, target suburbs, whether you already own land, budget band, project size, intended start window, and notes
  • Request a bond quote via our calculator tools — your name, email, mobile, approximate purchase price, and any message
  • Subscribe to our newsletter or update list — your email address and, optionally, your name

Information your browser sends automatically:

  • IP address
  • Browser type and version
  • Operating system
  • Pages visited on luxprop.agency
  • Referring URL (the page you came from)
  • UTM campaign parameters in the URL (for example, when you click an advertisement)

Information from cookies:

  • See section 6 below.

We do not collect special personal information (race, religion, health, etc.) and we do not knowingly collect personal information from anyone under the age of 18.

3. Why we collect it and what we do with it

We process your personal information for the following purposes:

We do not sell your personal information to anyone. Ever.

4. Who we share your information with

We share personal information only with the third parties listed below, and only to the extent strictly required for the purpose described.

  • BetterBond Private Clients — when you click “Get a real bond quote” on our tools page, your name, email, mobile and indicated purchase price are sent by email to our designated bond consultants, Verna Morrison and Heather Byerley, at BetterBond. By submitting that form you explicitly consent to this transfer for the purpose of obtaining a bond quote. BetterBond’s own privacy policy governs their subsequent use of your data.
  • Tonkin Clacey Attorneys — our nominated conveyancing partner. We share your contact details with them only once a sale has been agreed and a transfer needs to be opened, and only with your knowledge.
  • PropCtrl / Property24 — our customer-relationship management platform. Property enquiries you make about specific listings are logged in PropCtrl so the responsible agent can follow up.
  • MailerLite — our email marketing platform. If you opt into our newsletter your email address is stored on MailerLite servers, who process it on our instruction.
  • Google (Analytics & reCAPTCHA), Meta Platforms (Pixel), Vimeo — for site analytics, advertising attribution, spam protection, and video hosting respectively. These providers may set cookies on your device — see section 6.
  • Our hosting and technical providers — Afrihost (South African hosting) and incidental technical service providers (caching, security plugins, email delivery) who process data only on our instruction.
  • Law-enforcement, courts and regulators — where we are legally obliged to disclose, for example to the South African Police Service under a warrant, or to the Information Regulator under POPIA.

5. Cross-border transfers

Some of our processors are based outside South Africa (Google, Meta, MailerLite, Vimeo). Where personal information is transferred outside South Africa, we rely on the contractual safeguards those processors offer (their data processing agreements, standard contractual clauses, and their own POPIA / GDPR compliance commitments) to ensure your information remains adequately protected.

6. Cookies and tracking technologies

luxprop.agency uses cookies and similar technologies for the following purposes:

  • Essential cookies — needed for the site to function (for example, to remember your cookie-consent choice and to keep you logged in if you are an admin). These cannot be disabled.
  • Analytics cookies — set by Google Analytics, used to understand how visitors find and use the site. Anonymised by default.
  • Advertising cookies — set by the Meta Pixel, used to measure the effectiveness of our Facebook and Instagram advertising.

When you first visit the site, a cookie consent bar invites you to accept or decline non-essential cookies. You can change your choice at any time by clearing your browser’s cookies for our domain and reloading the site.

We do not use cookies to build advertising profiles about you for third parties.

7. How long we keep your information

After the retention period, we delete the records or render them irreversibly anonymous.

8. Your rights under POPIA

You have the right to:

  • Be informed about how we process your personal information (this policy is part of that)
  • Access the personal information we hold about you
  • Correct any of your personal information that is inaccurate or incomplete
  • Have your personal information deleted where there is no lawful reason for us to keep it
  • Object to our processing of your personal information for direct marketing
  • Withdraw your consent at any time (where we processed your data on the basis of consent)
  • Lodge a complaint with the Information Regulator (South Africa) if you believe we have not handled your personal information lawfully

To exercise any of these rights, contact our Information Officer using the details in section 10. We will respond within 30 days. Where we need to verify your identity before acting on a request, we will tell you what we need.

9. How we protect your information

We take reasonable, generally accepted technical and organisational measures to safeguard personal information against loss, unlawful access, interference, modification or unauthorised disclosure. These include:

  • HTTPS encryption across the entire luxprop.agency site
  • Strong, rotated administrative passwords and two-factor authentication on critical accounts
  • Limited internal access on a need-to-know basis
  • Vetted hosting and processor partners

No transmission over the internet is ever 100% secure. If we become aware of a security incident affecting your personal information, we will notify you and the Information Regulator as required by POPIA.

12. Changes to this policy

We may update this Privacy Policy from time to time to reflect changes in the law or in how we operate. When we make material changes, we will update the “Last updated” date at the top and, where appropriate, notify you directly. We encourage you to review this page periodically.
